These Terms of Use apply to your access to and use of the Gymmonkey website, member area, online booking services, and related digital services (“Online Services”).

Members may access certain Gymmonkey Online Services through third-party platforms provided by Wix, including the Fit by Wix app, where available.

By accessing or using the Online Services, you agree to these Terms of Use.

These Terms of Use govern your use of Gymmonkey’s digital services only. They do not replace or override the Gymmonkey Terms & Conditions, Booking, Cancellation & No-Show Policy, Privacy Policy, or any other terms that apply to specific Gymmonkey services.

 

2) Use of the Online Services

Gymmonkey provides online services to allow members to:

• create and manage their member account;

• book classes and services;

• manage bookings;

• receive service-related communications;

• access information about Gymmonkey services;

• access digital member groups and community discussion forums;

• view member-only wellness blogs, nutritional content, and educational resources.

Gymmonkey may update, modify, suspend, or remove features of the Online Services where reasonably required for operational, technical, or business reasons.

 

3) Member Accounts

To access certain Gymmonkey services, you may be required to create a member account.

You agree that:

• information provided by you must be accurate and kept up to date;

• you are responsible for maintaining the security of your account details;

• you must not share your login details or allow another person to access your account;

• you are responsible for activity carried out through your account unless caused by Gymmonkey’s error or unauthorised access outside your control.

Where available, you may update certain profile information through your member account. If you need to update information that cannot be changed through your account settings, please contact Gymmonkey.

If you believe your account has been compromised, you should contact Gymmonkey as soon as possible.

 

4) Acceptable Use

You agree not to:

• use the Online Services for unlawful purposes;

• attempt to gain unauthorised access to systems or accounts;

• interfere with the operation, security, or availability of the Online Services;

• copy, extract, modify, or misuse website content or functionality except where permitted;

• provide false information or impersonate another person;

• post, share, or transmit any content within Gymmonkey groups that is defamatroy, abusive, offensive, harrassing, or violates the privacy of other members;

• share sceenshots, copy, or distribute any member-only blog content, recipes, or guides outside of the Gymmonkey Online Services without prior written consent;

• use Gymmonkey community groups to advertise, promote, or sell third-party products, services, or external businesses to other members.

Gymmonkey may restrict or suspend access where reasonably necessary to protect the security of the Online Services, other users, or Gymmonkey’s operations.

 

5) Bookings and Payments

Bookings made through the Gymmonkey website or member area are subject to the Gymmonkey Booking, Cancellation & No-Show Policy.

Payments made through the Online Services are processed through applicable payment providers.

Your use of paid services is also subject to the Gymmonkey Terms & Conditions and applicable booking terms.

 

6) Website Availability and Changes

Gymmonkey aims to keep the Online Services available and functioning properly but does not guarantee that they will always be available, uninterrupted, or free from errors.

Access may occasionally be affected by:

• maintenance;

• technical issues;

• third-party service providers;

• circumstances outside Gymmonkey’s reasonable control.

• access may also depend on third-party platforms or internet services that are outside Gymmonkey's control.

Gymmonkey may update, suspend, or discontinue parts of the Online Services where reasonably required.

 

7) Content and Information

Gymmonkey aims to ensure that information provided through its Online Services is accurate and up to date.

However, information may occasionally contain errors or require updating.

Gymmonkey may correct, update, or change information relating to services, classes, availability, pricing, or other content without prior notice where appropriate.

 

8) Intellectual Property

All content provided through the Gymmonkey website and Online Services, including branding, text, images, graphics, and materials, belongs to Gymmonkey or its relevant licensors.

You may use this content only for personal, non-commercial use unless Gymmonkey provides permission otherwise.

8.1 User-Generated Content and App Data

Any data, text, or goals you input into the Gymmonkey Online Services or dedicated app remain your property. However, by posting within our community groups, you grant Gymmonkey a non-exclusive, royalty-free license to display your comments to other active members within that specific group. Gymmonkey reserves the right to remove any user-generated content or comments at its sole discretion without prior notice.

 

9) Security

Gymmonkey takes reasonable steps to protect its Online Services.

However, no online system can be guaranteed to be completely secure.

You are responsible for maintaining the security of any device or account used to access Gymmonkey Online Services, including access through third-party platforms such as the Fit by Wix app.

 

10) Limitation of Liability

To the fullest extent permitted by Irish law, Gymmonkey is not responsible for losses arising from:

• your inability to access the Online Services;

• technical interruptions;

• events outside Gymmonkey’s reasonable control;

• misuse of your account caused by your failure to keep account details secure.

Nothing in these Terms of Use limits or excludes liability where such liability cannot lawfully be limited or excluded.

 

11) Privacy

Your use of the Online Services is subject to the Gymmonkey Privacy Policy.

The Privacy Policy explains how Gymmonkey collects, uses, and protects personal data.
